Even though it has been a few years since I have lived in Jersey City, I still enjoy following the progress of the gold coast as it continues to reach up to meet the New York City skyline. If you can’t travel there to see what’s happening, the Jersey City Construction blog is the next best thing, and according to a recent post, the Jersey Journal just ran a story about hopes to extend the Hudson Bergen Light Rail west to Rt. 440 and north/west to the Meadowlands. Hopefully some of our “shovel ready” projects really will make it into the next administration’s stimulus plan.

When can a property owner challenge a municipality's determination that her property is "in deed of redevelopment"? Based on a recent New Jersey Appellate Division decision, the answer to that question may have changed.

A few months back I (along with Steve Eisendorfer, Esq. of Hill Wallack LLP) wrote an article analyzing the impact of the New Jersey Appellate Division case Harrison v. DeRose. The article is featured both on Hill Wallack’s main site and on its land use blog. The case is likely to be of interest not only to municipalities working to redevelop blighted areas, but for property owners concerned with the possibility that their poperty could be taken by eminent domain.
